INTRODUCTION
This document specifically governs the general terms and conditions for the purchase and use of the Gift Card on the website www.emarinella.eu
. For anything not expressly provided for in these General Terms and Conditions of purchase and use, reference is expressly and fully made to the General Terms and Conditions of Sale available on the Marinella website indicated above, in the section “Terms and Conditions”.
What the Gift Card Is
The Gift Card is a gift voucher that can be purchased online by accessing the website www.emarinella.eu
(hereinafter referred to as the “Website”), and can be used for personal purchases or given as a gift to a third party, exclusively for online purchases. It cannot be used to purchase products in Marinella stores, corners, or authorized retailers located in Italy or abroad. The Gift Card can therefore be purchased and used exclusively online.
Once the Gift Card purchase procedure is completed, an email containing the gift voucher code will be sent to the recipient (“Beneficiary”) indicated by the Purchaser at the time of purchase. The Gift Card will be immediately usable by the Beneficiary for purchasing products sold on the Website, without any need for activation, as it will be active from the moment the email is sent.
The Gift Card is issued by E. Marinella srl of Luigi, Maurizio and Alessandro Marinella, represented by its legal representative pro tempore Dr. Maurizio Marinella (hereinafter also “Marinella”), registered with the Naples Companies Register under number 04785580632, REA number 394895. The purchase and use of the Gift Card are governed by the General Terms and Conditions set out below.
The purchase of products on the Website is instead governed by the General Terms and Conditions of Sale available in the “Terms and Conditions” section of the Website.
1) Gift Card Purchase Methods
Customers wishing to purchase a Gift Card (hereinafter the “Purchaser”) must submit an electronic purchase order to the Seller (Marinella) by selecting the Gift Card product and adding it to the cart.
When selecting the Gift Card, the Purchaser must indicate its value, which cannot be less than €50.00 (fifty/00). The value of the Gift Card also constitutes its purchase price.
At the time of purchase, in addition to their own details and those of the Gift Card recipient, the Purchaser must provide a valid email address of the Beneficiary for delivery of the Gift Card. It is the Purchaser’s responsibility to ensure the email address is correct; Marinella shall not be liable for invalid email addresses.
To proceed with the order, the Customer must click “Add to cart.”

Gift Cards can be purchased using all payment methods available on the Website, as described in the “Payments” section.
By submitting the order form, the Purchaser confirms knowledge and unconditional acceptance of the General Terms and Conditions of Sale, these Gift Card terms, and the Privacy Policy.
No discounts or promotions of any kind may be applied to the purchase of a Gift Card, including offers available on the Website, which apply only to direct product purchases.
At the end of the purchase, the Gift Card and its code will be sent to the Beneficiary’s email address provided.
2) Right of Withdrawal
The Purchaser, as a consumer under Legislative Decree no. 206/2005, may exercise the right of withdrawal within 14 days from purchase, as specified in Article 5 of the General Terms and Conditions of Sale, except where applicable exclusively to products other than Gift Cards.
The right of withdrawal applies only if the Gift Card has not been used and must be exercised online.
If the withdrawal is valid, the Seller will refund the amount paid as soon as possible and in any case within 14 days from notification of withdrawal, using the same payment method used for purchase.
Upon receiving the withdrawal request and verifying that the Gift Card has not been used, Marinella will also notify the Beneficiary that the Gift Card and its code are no longer valid.
3) Use of the Gift Card
After completing the purchase, the Purchaser will receive an order confirmation email. At the same time, the Beneficiary will receive an email with the Gift Card code. The Gift Card is immediately active and requires no activation.
To use the Gift Card, the Beneficiary must follow the purchase procedure on the Website and, at checkout, select “Apply Gift Card” and enter the code. Only one Gift Card may be used per order.
The Gift Card may be used multiple times until its value is exhausted and within one year from issuance. After each purchase, the remaining balance will be updated automatically. The balance can be checked during checkout or in the user account section under “Gift Card.”
If the Gift Card balance is insufficient, the remaining amount may be paid using other available payment methods.
The Gift Card is for personal use only and cannot be resold. It cannot be used to purchase another Gift Card and cannot be converted into cash.
It is a bearer instrument equivalent to cash: if lost, stolen, misused, or damaged, it cannot be replaced, blocked, or refunded. Marinella is not responsible for improper or fraudulent use.
Ownership and risk transfer to the Purchaser or Beneficiary upon electronic delivery.
Gift Cards obtained through fraudulent or illegal means are void.
4) Validity Period
The Gift Card is valid for one year from the date of issuance. After expiry, it cannot be used and any remaining balance will not be refunded.
5) Returns and Withdrawal for Products Purchased with the Gift Card
If the Beneficiary exercises the right of withdrawal for products purchased using only a Gift Card, the refund will be issued using the same method as the Gift Card.
If other payment methods were used in addition, the Gift Card portion will be refunded as above, and the remaining amount via the original payment method.
In case of partial returns, refunds will be prioritized on the additional payment method.

6) Legal Guarantee of Conformity
Products purchased with a Gift Card are covered by the legal guarantee of conformity as per Article 6 of the General Terms and Conditions of Sale.
7) Privacy and Personal Data Processing
Pursuant to Article 14 of EU Regulation 2016/679, E. Marinella srl informs that personal data provided by third parties for Gift Card use will be processed in accordance with this notice.

Personal data (name and email of the recipient) are used exclusively for sending and managing the Gift Card. The legal basis is contract execution (Art. 6(1)(b) GDPR).
Data are processed using IT tools with appropriate security measures and retained only as necessary, then archived in compliance with tax laws.
Data will not be disclosed and may be accessed only by authorized personnel, service providers, or authorities where required by law.
Data subjects have rights of access, rectification, erasure, restriction, objection, and portability. Complaints may be lodged with the Italian Data Protection Authority.

In case of malfunction, the Purchaser or Beneficiary must promptly notify Customer Service within legal time limits.
9) Applicable Law and Dispute Resolution
Applicable law, dispute resolution, and jurisdiction are governed by Article 16 of the General Terms and Conditions of Sale available in the “Terms and Conditions” section of the Website.
